3.5. Availability and Functioning of Integrations.
The User acknowledges that the availability and correct functioning of these integrations depend on the policies and technical stability of these third-party companies. 3APPS is not responsible for any instabilities, API changes, or interruptions in the services of third-party companies that may temporarily affect Platform functionalities that depend on them.
4. Registration and Access
4.1. Minimum Age for Use.
Use of the Platform is permitted only to persons aged 16 (sixteen) or older. By registering, the User declares, under penalty of law, that they meet the minimum age requirement. 4.10. Communication of Misuse of Credentials.

4.11. Registration Update and Provision of Information.
The User declares to be aware and agree that they must keep their registration permanently updated on the Platform, providing the information and documents necessary for this purpose, if requested by 3APPS.
5. Subscriptions and Plans
5.1. Free Plan.
The Platform provides a free modality (“Free Account”), which allows the User to test certain features for a maximum period of 1 (one) day. This access is granted as an initial experience and does not constitute an obligation to provide continuous and free services. After the end of the testing period, full access to the Platform’s features will depend on subscribing to one of the available paid plans.
5.2. Paid Plan.
The paid plan offers additional resources, expanded functionalities, and advanced personalization and tracking tools, operating through a monthly or annual subscription, which allows for a monetary charge based on the benefits added to this type of account. Specific characteristics, values, and conditions will be informed within Befit at the time of contracting. 3APPS may update the plans and their conditions through a notice via the Platform or the User’s email.
5.3. Paid Plan and Scope of Functionalities.
In the Paid Plan, the User will have access to expanded functionalities, including, but not limited to: (i) configuration of personalized workouts by the User themselves; (ii) generation of personalized workouts through artificial intelligence (Befit AI), based on the informed objectives; (iii) registration of personal goals, including specific periods of intensification; (iv) monitoring and measurement of training progress; and (v) access to technical descriptions and demonstrative videos for guidance on exercise practice.
5.4. Alteration of Functionalities and Plan Conditions.
The services, functionalities, benefits, and conditions provided in each plan may be modified, expanded, or discontinued by 3APPS upon communication to the User, without any reimbursement or refund being due to the User.
5.5. Automatic Subscription Renewal.
Subscriptions are automatically renewed at the end of each billing cycle, unless they are canceled at least twenty-four hours before the end of the current subscription period. The applicable platform (Apple or Google) will charge your account for renewal within twenty-four (24) hours before the end of the current billing cycle, at the subscription rate effective at that time. That is, the User authorizes the recurring charge at the end of each contracted period, extending the service for a new period equivalent to the previous one.
5.6. Deleting or uninstalling the application does not cancel your subscription.
5.7. The Platform subscription will be charged to the User according to the terms, deadlines, and values provided on the Platform at the time of the User’s registration, who agrees that the Subscription value will be charged as shown at the time of contracting.
5.7.1. Price upon Subscription Renewal.
Subscription renewal may include price adjustments or corrections, especially for contracts signed during promotional periods, subject to the conditions and rules in force at the time of renewal, to which the User will be fully subject.
5.8. Promotional Campaigns and Absence of Vested Rights.
5.9. Effects of Cancellation and Possible Loss of Data.
5.9. Effects of Cancellation and Possible Loss of Data.
After cancellation, the non-renewal of the subscription will result in the deactivation of the contracted functionalities, which may result in the loss of stored information that cannot be recovered if the User chooses to renew the subscription later.
5.10. Residents of the European Economic Area and the United Kingdom
May have the legal right to withdraw from the purchase within fourteen (14) days from the date of purchase, subject to applicable exceptions for digital content. By expressly consenting to immediate access to digital content, you acknowledge that your right of withdrawal may be reduced or nullified in accordance with applicable law.
6. Refunds and Cancellation
6.1. Subscription Cancellation.
Subscriptions are contracted through the App Store (Apple) or Google Play and are processed and managed exclusively by the respective app stores. Cancellation is the sole responsibility of the User with the platform where the purchase was made. 3APPS does not have direct access to the stores’ billing systems and, therefore, cannot perform cancellations, suspensions, or refunds of subscriptions contracted through these means. The User declares to be aware that the cancellation request must be made directly in the App Store or Google Play subscription settings, observing the rules and deadlines established by the respective store.
6.1.1. Account Deletion, Application Uninstallation, and Subscription Maintenance.
Deleting the User’s account or deleting the Befit application from the smartphone does not automatically cancel the subscription. In case of doubt, the User may also consult our Help Center.
6.2. Right of Withdrawal.
The User has a period of 7 (seven) days to cancel the active plan and request a refund of the amount of the purchased subscription. After this period, it is only possible to cancel the automatic renewal of the subscription. Thus, if the plan is paid in installments and no refund request is made within the first 7 (seven) days after purchase, the installments will remain active, as the cancellation of the automatic renewal does not constitute a refund of the subscription.
6.2.1. Absence of Installment Refund.
3APPS will not refund the User after the period for exercising the right of withdrawal has elapsed and will not refund paid amounts, whether full or proportional to the unused period, considering that the 12 (twelve) installments of the subscription is merely a payment convenience for the User.
6.3. Account Deletion and Subscription Maintenance.
Deleting the User’s account does not automatically cancel their active subscription. To learn more about how to cancel your recurrence—that is, the automatic renewal of the subscription—please visit our Help Center.
6.4. Continuity of Access for the Paid Period.
If the User cancels the automatic renewal of the subscription, the current days are not lost. The subscription recurrence is the only thing affected in this process, meaning it will not be automatically renewed at the end of the period.
6.5. Account Cancellation.
The Platform may, at any time, request proof of age and suspend or cancel accounts that show signs of false information or failure to comply with the established minimum age.
6.6. Content Deletion.
All content linked to the Subscription will be deleted from the Platform within five years after account cancellation, although 3APPS may retain certain data to comply with legal or contractual obligations, as described in the “About data storage and access” section of the Privacy Policy. In any case, the information cannot be recovered after the account is canceled.
6.7. Hypotheses for User Account Cancellation.
Without prejudice to any damages that 3APPS may claim, it has the right to suspend or cancel the User’s access, subscription, and/or account to the Platform, without prior notice, compensation, or refund, if the User does not comply with the Terms, especially if they:
- Do not respect 3APPS’s Intellectual Property rights;
- Bypass or attempt to bypass technical protection measures applied by 3APPS;
- Fail to provide the information necessary to complete their registration, at 3APPS’s sole discretion;
- Provide false information;
- Do not pay the full price of the subscription;
- Perform activities harmful to the commercial interests of 3APPS, at its sole discretion;
- Make any public comment that may denigrate the image of 3APPS;
- Practice verbal, physical, written, or other abuse (including threats of abuse) against any employee, consultant, subcontractor, director, or other Users of 3APPS, at its sole discretion; and
- Alter, decompile, convert, or modify the factory settings of their smartphone, or practice reverse engineering, so as to enable vulnerability of 3APPS data or sources and leave it susceptible to potential exposure or any other form of copying or modifying 3APPS’s application systems, at its sole discretion.
7. User Obligations
7.1. User Obligations.
In addition to what is provided in the other provisions of these Terms, the User undertakes to: (i) make available to 3APPS all information it needs to achieve the object of this Agreement; and (ii) provide and maintain true, accurate, current, and complete information, assuming civil and criminal liability for any falsehood.
7.2. Responsibility for Information Provided and Use of the Platform.
The User is entirely responsible for the information entered into their account, especially regarding the quantity of products, in addition to being responsible for all their actions that involve, directly or indirectly, the Platform. 3APPS is not responsible for damages resulting from outdated or incorrect information provided by the User, nor for damages arising from their attitudes and choices.
7.3. Prohibitions to the User.
Without prejudice to the obligations assumed, the User is not permitted, under any pretext, for example, to:
- Improperly use data of other users or third parties to which they have access through the Platform, fully respecting the General Data Protection Law (LGPD);
- Use 3APPS services for any illicit purposes, fraud, scams, or to remunerate illegal activities;
- Use any automated system, software, bot, or reverse engineering technique to access, copy, or extract data from the Platform, as well as not practice spam or send unsolicited mass messages;
- Create multiple User accounts with the intent to circumvent rules, obtain undue advantages, or bypass previous suspensions;
- Disclose or store on the Platform materials that are offensive, pornographic, or that promote or apologize for terrorism, violence, or any form of discrimination, whether racial, sexual, of origin, religious, or that, even in other ways, violates human rights; and
- Disclose content or practice any act that infringes or violates the rights of third parties or the law.
7.4. Right to Contest Penalties.
Should the User disagree with any applied penalty, they may present a formal and justified contestation through 3APPS’s official service channels, which will be analyzed by the company.
7.5. Duty of Good Faith and Observance of Applicable Legislation.
It is the duty of Users, when using the Products, to always follow good faith in civil relations, following the provisions of the legislation, regulations, ordinances, and other legal norms in force.
7.6. Acknowledgment of Risks Inherent to the Practice of Physical Exercises.
The User declares to be aware that the practice of physical exercises involves inherent risks and must be performed with caution and responsibility. It is recommended that all physical activity be accompanied and supervised by a duly qualified Physical Education professional, especially for the adaptation of exercises to the practitioner’s individual conditions.
7.7. Informational Nature of the Provided Content.
The videos, workouts, guidelines, explanatory content, and other materials available in the application are for informational and educational purposes only, not constituting an individualized workout prescription, nor replacing in-person or remote monitoring by a qualified professional.
7.8. Recommendation for Medical Evaluation and Professional Monitoring.
The User further acknowledges the importance of maintaining regular physical evaluation and medical monitoring, and should consult a healthcare professional before starting or modifying any exercise program, especially in case of a history of diseases, injuries, physical limitations, or any pre-existing health conditions.
7.9. Assumption of Risks and Sole Responsibility of the User.
The use of the application is performed at the User’s sole risk and expense, who assumes full responsibility for their physical condition and for the decision to start or maintain the practice of exercises.
8. Responsibilities
8.1. Absence of Guarantee of Results and Exclusion of Liability for Frustration of Expectations.
3APPS does not guarantee, promise, or ensure any specific result related to weight loss, muscle mass gain, body definition, physical conditioning, rehabilitation, performance improvement, or any other objectives intended by the User. Results arising from the practice of physical activities vary significantly according to individual factors, such as previous physical condition, health status, genetics, age, diet, regularity, training intensity, discipline, among other aspects that are independent of the Platform’s performance. 3APPS does not assume an obligation of result, but merely provides a technological tool to support the organization and monitoring of workouts. The User acknowledges that the eventual failure to obtain the desired results, as well as the frustration of personal expectations, does not characterize a failure in the provision of the service, a flaw, a defect, or a breach of contract, nor does it generate the right to indemnity, refund, or compensation of any nature.
8.2. Absence of Liability of 3APPS.
3APPS shall not be liable, under any circumstances, for any damages arising from:
- Misuse of the Platform by the User or third parties;

- Losses resulting from incidents related to the security of the User’s access credentials not immediately communicated to 3APPS; and
- Acts caused by events of fortuitous circumstances or force majeure.
8.3. Exemption of Liability for Acts of Third Parties.
3APPS exempts itself and is released from any liability for losses and damages of any nature, lost profits, and consequential damages that may arise from the actions of third parties (including other Users).
8.4. Suspension or Cancellation for Breach of Contract.
3APPS reserves the right to, at any time, suspend or cancel the User’s access in the event of non-compliance with their responsibilities and obligations, without the right to any compensation in favor of the User and without prejudice to the application of the sanctions already provided for.
8.5. Limitation of Liability and Exclusion of Indirect Damages.
In any case, the maximum liability of 3APPS arising from this Agreement shall be limited to the total amount of the monthly fees actually paid by the User in the last 6 (six) months prior to the harmful event. This limitation is restricted to direct damages proven to have been suffered by the User due to any breach of 3APPS’s obligations, excluding any and all claims for indirect damages (including lost profits and loss of data or business opportunity) suffered by the User or by any third party.
8.6. Availability of the Platform and Absence of Guarantee of Uninterrupted Operation.
3APPS will make efforts to ensure that the services offered are fully accessible at all times. However, there is no guarantee that access and use will occur without any failure or in an uninterrupted manner. 3APPS cannot be held liable due to the impediment or change in the form of access to the services, and it exempts and exonerates itself from any liability for damages of any nature that may be caused by the lack of continuity or operation thereof.
